Florida Jury Awards $90 Million Verdict to Smoker's Widow

$90,000,000 - Tobacco Litigation Verdict

Morgan and Morgan is pleased to announce that attorneys Keith Mitnik and Greg Prysock recently obtained a jury verdict of $90.8 million in Townsend v. R.J. Reynolds Tobacco Co., 08-CA-131, Florida Circuit Court (Gainesville). Mr. Mitnik and Mr. Prysock represented Lyantie Townsend in this lawsuit against R.J. Reynolds Tobacco Co., the second-biggest U.S. cigarette maker. Lyantie Townsend was widowed when her husband Frank died from lung cancer in 1995. He had been a smoker since age 13 or 14. The six state court jurors voted unanimously in her favor.

The jury awarded his widow a total of $10.8 million in compensatory damages and $80 million in punitives. The jury determined that the tobacco maker was 51 percent at fault, and Townsend was 49 percent liable. Florida does not require punitive damages to be reduced by comparative negligence, but Prysock said their client agreed to apportion damages based on the assignment of fault.
